What Are Offshore Sportsbooks?
Offshore sportsbooks are licensed outside the US. They accept Americans without state restrictions. A bettor in California and one in New York can access the same international betting sites on the same terms.

After PASPA was struck down and states began licensing their own operators, offshore betting sites found a structural advantage: no state tax obligations. A domestic operator holds a license that only functions in that specific state. Is Offshore Sports Betting Legal for US Players?
The legal status sits in a gray zone. Federal law does not criminalize a US bettor for opening an account and placing wagers at international betting sites. Every enforcement action in recorded US legal history has targeted operators and payment processors, not individual bettors. That said, this is not legal protection, state laws vary, and none of this is legal advice. Consult an attorney in your state if you need certainty.

As of May 2026, sports betting is legal in 39 states plus Washington DC, with 30 of those states offering legal online betting through licensed apps (Fox Sports, May 2026). Missouri launched in December 2025. Wisconsin signed online betting into law on April 9, 2026, but a launch date has not been confirmed. California, Texas, Georgia, Alabama, Minnesota, and Oklahoma remain without legal online options. Florida restricts online betting to Hard Rock Bet only under the Seminole compact.
For bettors in those blocked states, international betting sites aren’t a secondary option. They’re the only path to online wagering. In states where legal options exist, many bettors use both: a domestic book for everyday action and an offshore betting site for higher limits, larger bonuses, deeper props, and markets regulated apps won’t carry, including college player props, which are banned in over 20 states that otherwise allow sports betting.
Gambling winnings are taxable regardless of where you bet. The IRS treats winnings from offshore betting sites the same as domestic ones. Report net winnings on Form 1040 Schedule 1, line 8b. Offshore books don’t issue W-2G forms, so reporting is on you. Failing to report offshore gambling winnings constitutes tax evasion. Keep a wagering log from January 1: date, sport, book, stake, result.
Are Offshore Sports Winnings Taxable?
Yes. The IRS taxes gambling winnings regardless of location. Winning at an international betting site carries the same federal tax obligation as winning at a regulated domestic book. The difference is paperwork.
Domestic US sportsbooks must issue Form W-2G for winnings above $600 at 300:1+ odds or $5,000+, per IRS Publication 525. Offshore sportsbooks operate outside US jurisdiction and issue no W-2G forms, per IRS guidance on gambling income. That transfers 100% of tax compliance onto you.
Report net gambling winnings on Schedule 1 of Form 1040, line 8b. Deductible losses go on Schedule A, capped at your reported winnings. Keep a spreadsheet with deposits, withdrawals, and per-bet results from January 1 every year. Not reporting is tax evasion, not a gray area.
